1. Service Description

Imagera AI ("the App") is an AI-powered image generation platform available on iOS. The App provides:

• Text-to-Image: Generate images from text prompts with various artistic styles.
• AI Avatar Filters: Transform your photos using AI-powered filters across multiple categories.
• Multi-Avatar System: Create and manage multiple avatars for personalized AI generation.

2. Acceptance of Terms

By downloading, installing, or using Imagera AI, you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

3. Account & Device Identification

Imagera AI does not require traditional account registration (no email or password). Instead, the App uses a unique device identifier (UUID) stored in your device's Keychain to identify your account. This identifier persists across app reinstalls but may be lost upon factory reset.

4. Credit System

• The App operates on a credit-based system. All features require credits to use.
• Text-to-Image generation costs credits per generation.
• AI Avatar Filter generation costs credits per generation.
• Credits can be purchased as consumable in-app purchases.
• No refunds are provided for purchased credits, except as required by applicable law or Apple's refund policies.
• Credits are tied to your device identifier. If your device identifier is lost (e.g., factory reset), your credit balance cannot be recovered.
• All users, including subscribers, spend credits for each generation.

5. Subscriptions

• Imagera AI offers auto-renewable subscriptions through the App Store.
• Subscribers receive a weekly credit refill automatically.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your device's Settings → Apple ID → Subscriptions.
• Payment is charged to your Apple ID account at confirmation of purchase.

6. AI-Generated Content

• You retain ownership of images you generate using the App.
• You may use AI-generated images for personal or commercial purposes.
• Generated images are stored on your device and synced within your iCloud account (CloudKit).
• We do not guarantee the accuracy, quality, or suitability of AI-generated content.
• AI-generated images may occasionally produce unexpected or imperfect results. This is inherent to AI technology.
• We reserve the right to use anonymized, aggregated usage data to improve our services.

7. User Photos & Avatar Data

• When you create avatars, your photos are uploaded to our cloud storage (Firebase Storage).
• Your photos are sent to third-party AI services (Replicate) for image generation processing.
• You are responsible for ensuring you have the right to upload any photos you provide.
• Do not upload photos of other people without their consent.
• We do not use your photos for any purpose other than providing the App's features.

8. Acceptable Use

You agree not to use the App to:

• Generate illegal, harmful, abusive, or offensive content.
• Create deepfakes or misleading images of real people without consent.
• Generate content that infringes on intellectual property rights.
• Attempt to reverse-engineer, hack, or exploit the App or its backend services.
• Circumvent rate limits or abuse the credit system.
• Use the App for any unlawful purpose.

We reserve the right to suspend or terminate access for users who violate these terms.

9. Intellectual Property

The Imagera AI name, logo, design, and underlying technology are the property of the developer. You may not copy, modify, or distribute any part of the App without permission.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation, nor do we guarantee the quality or accuracy of AI-generated content.

11. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or service interruptions.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Turkey.
